Agreement to Terms
By accessing or using the sparkle-dock website and services, you agree to be bound by these Terms of Use. If you disagree with any part of these terms, you may not access our services.
Booking and Reservations
Reservation Process
When you book an expedition with sparkle-dock:
- You must provide accurate and complete information
- You must be at least 18 years of age or have parental/guardian consent
- Your reservation is confirmed upon receipt of payment
- All prices are in Canadian Dollars (CAD) unless otherwise stated
Payment Terms
- A deposit of 50% is required to secure your booking
- Full payment is due 30 days prior to the expedition start date
- We accept major credit cards and bank transfers
- All payments are processed securely through encrypted channels
Cancellation Policy
- Cancellations 30+ days before departure: Full refund minus 10% administrative fee
- Cancellations 15-29 days before departure: 50% refund
- Cancellations within 14 days of departure: No refund
- We reserve the right to cancel expeditions due to weather, safety concerns, or insufficient bookings. In such cases, you will receive a full refund or the option to reschedule
Participant Responsibilities
Physical Fitness
You are responsible for ensuring you have the appropriate fitness level for your chosen expedition. We provide fitness guidelines for each experience, and you must honestly assess your capabilities.
Health and Safety
You must:
- Disclose any medical conditions that may affect your participation
- Follow all safety instructions provided by guides
- Use provided safety equipment properly
- Inform guides immediately of any health concerns during the expedition
Conduct
Participants are expected to:
- Respect other participants and guides
- Follow Leave No Trace principles
- Refrain from behavior that endangers themselves or others
- Comply with all applicable laws and regulations
Assumption of Risk
Wilderness activities involve inherent risks. By participating, you acknowledge that:
- Outdoor activities carry risks of injury or death
- Weather and natural conditions are unpredictable
- You voluntarily assume these risks
- You are responsible for your own safety and decisions
Liability and Indemnification
To the fullest extent permitted by law:
- sparkle-dock is not liable for injuries, losses, or damages arising from your participation
- Our liability is limited to the amount you paid for the expedition
- You agree to indemnify sparkle-dock against claims arising from your actions
- This does not limit our liability for gross negligence or intentional misconduct
Insurance
We strongly recommend that all participants obtain:
- Travel insurance covering trip cancellation and interruption
- Medical insurance with emergency evacuation coverage
- Personal liability insurance
sparkle-dock does not provide personal insurance coverage for participants.
Intellectual Property
All content on this website, including text, images, logos, and design elements, is the property of sparkle-dock and protected by copyright laws. You may not:
- Reproduce, distribute, or modify our content without permission
- Use our trademarks or branding without authorization
- Frame or link to our website in a misleading manner
Photography and Media
During expeditions, guides may take photographs or videos that may include participants. By participating, you grant sparkle-dock permission to use such media for marketing purposes unless you opt out in writing.
Changes to Itineraries
We reserve the right to modify expedition itineraries due to:
- Weather conditions
- Safety concerns
- Natural events or disasters
- Group capabilities and dynamics
Such changes do not entitle participants to refunds, though we will make reasonable efforts to provide comparable experiences.
Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference.
Dispute Resolution
Any disputes arising from these terms or your use of our services will be governed by the laws of Alberta, Canada. You agree to submit to the exclusive jurisdiction of courts in Alberta for resolution of disputes.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Changes to Terms
We reserve the right to modify these Terms of Use at any time. Changes will be effective when posted on this page. Continued use of our services after changes constitutes acceptance of the modified terms.
